Extension and change of status from H2-B or J-1 to B-2 (visitor) category

We can assist you with your application for an extension of stay and/or change of status from H2-B or J-1 to B-2 category, which will allow you to stay in the US for an additional six months as a visitor.

However, we cannot help with extending working status (J-1, H2-B, etc.), as it requires an employer. Only your work visa sponsor (i.e. your employer) can apply for an extension of your J-1 or H2-B status.

On the other hand, we can help you to apply for a change of status and/or extension of stay change of status from H2-B or J-1 to B-2 to B-2 (visitor) category, which can help you stay legally in the US for up to six (6) months. It is important to note that applications for a change of status and/or extension of stay in the B-2 category may be initiated at least 90 days before the I-94 departure record or US work visa expires.


To initiate the process, please send us the documents listed below via email, and we'll confirm receipt of your email. Please note that any documents not in English will require translation. Once we receive your application, we will process it quickly and complete your case within a few days.

Documents needed
- Your U.S. visa
- Your passport (the last page with your personal information)
- A bank statement showing a minimum ending balance of approximately $3,000 per person
- If you have an H2B, J-1, or similar visa, please supplement your bank statement with the last 3-6 pay stubs, payment checks, or earnings statements from your employer. If possible, please attach both the bank statement and the payment checks
- Optional: letters of support from U.S. relatives, friends, etc. (recommended)
- Optional: a copy of your airline ticket (if available) (recommended)
- If you have a work visa (H-2B, J-1, H2R), please provide a copy of your previous SSN card (if applicable)
- If you have a J-1 visa, please provide a copy of your SEVIS form DS

- Fill out the "Extension of Stay" form and email the completed PDF form to us. The PDF form is editable and you can type on it. Save the PDF file to your computer first, then open and complete the form, and email the completed PDF along with the above documents for your convenience.

Our agency charges a $200 fee for extending your stay. Please complete and email the "Extension of Stay" PDF form along with your documents. Payment details will be sent upon receipt of your email.

We cannot help you if
- Your J-1 visa says "holder is subject to section 212(E), two year rule applies".
- You have engaged in unauthorized employment and are therefore considered in violation of your current status, visa/program status - (e.g., a J-1 exchange visitor may be employed only by the exchange visitor program sponsor or its designee and within the guidelines of the State Department-approved program as outlined in the Form DS-2019, Certificate of Eligibility, issued by the program sponsor - (underline added).

It is important to consider the following points when applying for an extension
i) Ensure that your U.S. mailing address is reliable and stable for at least six months to receive notifications from USCIS. If you need to change your mailing address during the extension process, we can help you with that. However, we strongly advise that you make sure that your mailing address remains unchanged during the extension process for six months to avoid any complications.

ii) Please provide us with all the necessary information and pay attention to the details when submitting your extension request via email. This will help us to assist you better and increase the chances of getting your case approved.

iii) Make sure to write your name on your mailbox so that the postman can see it. This is important as you will not receive a USCIS notice if your name is not displayed in the mailbox. The Post Office follows this policy as the mail comes from the U.S. Government - (USCIS).

For your second extension
If your current extension has been approved by the USCIS and you would like to apply for a second extension - we always ask for six months (we will again require the above-mentioned copies - see details above), plus a bank statement of yours, as well as a copy of the USCIS Approval Notice(s) for all previous or current extensions or changes in status since you last entered the United States.

In the event of an emergency, if you are approaching the deadline for filing and are at risk of overstaying your valid I-94 departure record or U.S. visa, please keep in mind that the USCIS is very strict when it comes to time limits and deadlines. Therefore, we kindly request that you submit the documents listed above as soon as possible. To stay in the United States legally, it is important to maintain legal status while in the country, and to apply for an extension of stay and/or change of status. It is advisable to start the process of applying for a change of status and/or extension at least 60 days before the expiration of your I-94 departure record or U.S. visa. If you leave the U.S. without valid status, you may not be allowed to re-enter the country. Overstaying your allotted time in the U.S. may result in serious consequences and jeopardize your next visit. including a three to ten-year ban from the U.S.

It's important to be aware of immigration scams. Dealing with the wrong people can cause problems for you. Whenever you apply to USCIS to change your status or to extend your stay, you should receive a USCIS Notice within 30 days. This notice includes a case number and informs you of the ongoing and pending case. Be cautious of individuals or agencies that are unscrupulous or fraudulent. If you do not receive a USCIS notice or case number within 30 days, you should start asking questions. If you get the runaround from them, it could mean that your case has never been submitted to USCIS. This could put you out of status without your knowledge. The USCIS will start processing your application as soon as they receive it, and you'll receive your case number within 30 days. They will also send you a notice by mail informing you of the case. All communications from the USCIS will come directly to you, so watch out for scammers.
